Mars Group TV respects copyrights, trademarks, and other intellectual-property rights. This policy explains our standards for lawful content use and how rights owners may report material they believe infringes their rights.

Ownership remains with the relevant creators, producers, publishers, broadcasters, licensors, or other rights holders.

References to third-party material do not transfer those rights to Mars Group TV.

4. Trademarks and Brand References

4.1 Mars Group TV branding

The Mars Group TV name, original logo, visual identity, and related brand materials may be protected by applicable trademark, unfair-competition, or other laws.

You may not use Mars Group TV branding in a way that:

  • Impersonates Mars Group TV.
  • Creates a misleading website or account.
  • Suggests a false partnership.

4.2 Third-party trademarks

5. Copyright Infringement Notices

  9. A statement, made under penalty of perjury, that the complainant is the copyright owner or is authorized to act for the owner.
  10. Any supporting registration, ownership, licence, or authorization information that may help us assess the complaint.

A general allegation that the entire website or service is infringing may not provide enough information for us to locate and assess the disputed material.

5.2 Complete and accurate notices

A complaint should identify specific material rather than requesting the removal of lawful, licensed, unrelated, or unidentified content.

Mars Group TV may request additional information where a notice:

  • Is incomplete.
  • Does not identify the protected work.
  • Does not provide a specific location.
  • Does not establish the complainant’s authority.
  • Concerns trademark rather than copyright.
  • Appears fraudulent or abusive.
  • Conflicts with available licence information.

Deliberately submitting false ownership information may have legal consequences.

Sending a notice to an unrelated support address, social-media account, payment provider, or sales representative may delay its review.

A notice sent by email should include all required information in the message or in a readable attachment.

7. Review, Removal and Notification

7.1 Initial review

After receiving a sufficiently complete notice, Mars Group TV may:

  • Confirm receipt.
  • Review the identified material.
  • Examine ownership or licence records.
  • Request clarification.
  • Contact the relevant supplier or account holder.
  • Remove or disable access to disputed material.
  • Reject a notice that does not establish a reasonable claim.
  • Preserve relevant records.

The time needed for review may depend on the complaint’s complexity and the information supplied.

7.2 Expeditious action

Where a notice satisfies the applicable legal requirements and identifies material that appears infringing, Mars Group TV will act without unreasonable delay.

Action may include:

  • Removing the material.
  • Disabling access.
  • Restricting an account.
  • Removing a link.
  • Suspending a relevant feature.
  • Contacting the party responsible for the material. 

7.3 Notification of the affected party

Where appropriate, Mars Group TV may provide the affected customer, user, supplier, or account holder with:

  • A copy or summary of the complaint.
  • The complainant’s contact information.
  • Identification of the affected material.
  • Information about submitting a counter-notification.
  • Notice of account restrictions.

Information may be withheld where disclosure is prohibited by law or creates a credible security risk. 

8. Counter-Notifications

A person who believes material was removed or restricted because of a mistake or misidentification may submit a counter-notification. 

8.1 Information required

A counter-notification should include:

  1. The sender’s physical or electronic signature.
  2. Identification of the material that was removed or disabled.
  3. The location where the material appeared before removal.
  4. A statement under penalty of perjury that the sender has a good-faith belief that the material was removed or disabled because of a mistake or misidentification.
  5. The sender’s full name, address, telephone number, and email address.
  6. Consent to the jurisdiction of the appropriate United States federal district court.
  7. If the sender is outside the United States, consent to the jurisdiction of the federal district court covering Mars Group TV’s location.
  8. A statement agreeing to accept service of process from the original complainant or the complainant’s authorized representative.

8.2 Restoration of material

After receiving a valid counter-notification, Mars Group TV may provide a copy to the original complainant.

Where Section 512 applies, removed material may be restored within the legally applicable period unless the original complainant informs us that legal proceedings have been filed seeking to restrain the disputed activity.

Submitting a counter-notification does not guarantee restoration where:

  • The material independently violates our Terms of Service.
  • Another valid legal reason supports removal.
  • The account presents a security or fraud risk.
  • Restoration is prohibited by law.
  • Mars Group TV lacks a lawful basis to make the material available.

9. Repeat-Infringer Policy

Mars Group TV does not permit repeated or deliberate intellectual-property infringement.

Where appropriate, Mars Group TV may restrict or terminate accounts associated with:

  • Multiple valid infringement notices.
  • Repeated unauthorized distribution.
  • Deliberate evasion of prior restrictions.
  • Resale of unauthorized access.
  • Submission of material after prior removal.
  • Serious or intentional infringement.
  • Failure to provide requested rights documentation.

We assess cases individually and may consider:

  • The number and credibility of notices.
  • Whether notices concern the same material.
  • Available licence records.
  • Counter-notifications.
  • Court orders or legal decisions.
  • Evidence of deliberate misconduct.
  • The customer’s response and cooperation.

Mars Group TV may take immediate action in serious cases without waiting for repeated notices.

10. Trademark and Brand Complaints

The DMCA notice-and-takedown process addresses copyright. Trademark concerns should be submitted separately.

A trademark complaint should include:

  • The complainant’s name and contact information.
  • Identification of the trademark owner.
  • The trademark or service mark at issue.
  • Registration details, where applicable.
  • The country or jurisdiction of protection.
  • The goods or services associated with the mark.
  • The exact URL or location of the disputed use.
  • An explanation of why the use is unauthorized or confusing.
  • Evidence that the complainant is the owner or authorized representative.
  • A good-faith statement that the complaint is accurate.
  • A physical or electronic signature.

Mars Group TV may remove, modify, or restrict material that creates a credible risk of:

  • Customer confusion.
  • Brand impersonation.
  • False affiliation.
  • Counterfeit activity.
  • Fraudulent support or payment activity.

A trademark complaint should not be submitted as a DMCA notice unless it also involves a genuine copyright claim. 

11. False or Abusive Complaints

Do not submit a notice or counter-notification containing information you know is false.

Prohibited conduct includes:

  • Pretending to own rights you do not own.
  • Claiming authority you do not have.
  • Misidentifying licensed material as unauthorized.
  • Using the process to silence criticism.
  • Attempting to remove a competitor’s lawful content.
  • Submitting automated notices without reviewing the identified material.
  • Altering ownership documents.
  • Repeatedly resubmitting a rejected claim without new evidence.

Mars Group TV may reject abusive complaints and preserve relevant records.

Where appropriate, we may report suspected fraud, impersonation, or unlawful conduct to a payment provider, platform, regulator, rights owner, or law-enforcement authority. 

12. No Admission of Liability

Removing, restricting, restoring, or retaining material does not constitute:

  • An admission of infringement.
  • A declaration of ownership.
  • A waiver of legal rights.
  • Acceptance of every allegation in a notice.
  • A final legal determination.

Mars Group TV may take temporary action while investigating a complaint.

We reserve the right to remove material that violates our Terms of Service even where the material does not infringe copyright.

We may also decline to remove material where credible evidence establishes ownership, authorization, licensing, public-domain status, or another lawful basis.

13. International Complaints

Mars Group TV may consider intellectual-property complaints submitted under laws outside the United States.

International complainants should provide:

  • The country where protection is claimed.
  • The applicable registration or ownership information.
  • The specific material involved.
  • The precise website or service location.
  • An explanation of the rights allegedly violated.
  • Evidence of authority to act.

We may apply United States law, applicable local law, contractual requirements, or another appropriate process depending on the complaint and service location. 

14. Changes to This Policy

Mars Group TV may update this policy when:

  • Its content procedures change.
  • New reporting methods become available.
  • Legal requirements change.
  • A copyright contact changes.
  • Additional intellectual-property protections are introduced.
